Don’t let the terminology fool you. This is where the state has the right to
charge you for a DUI becuase you refused to submit to a blood alcohol test. In
effect, you have already plead guilty if you refused to take this test. If this is
your first offense, you will be charged the same as a first time offender. If this
is your second offense, you will be charged as a second time offender... you
get the picture. Refusing to take the blood alcohol test often results in more
serious consequences than if you simply let the police do their job. You will
need a specialized attorney to represent you in court for this violation. If you go
to court without a good attorney, you more than likely will get the maximum fine
and jail time allowed by the law.
